The term 'Seller' refers to the trading name of 'Oakita Limited' and the website www.oakita.co.uk. The term 'Customer' refers to the person or company to whom this document is addressed.
These terms and conditions are applicable to the supply of products procured, manufactured or sold by the Seller to the Customer with reference to the aforementioned definitions.
2.1 All prices are quoted in Pounds Sterling and are inclusive of VAT at the current rate where applicable unless otherwise specified.
2.2 All prices are exclusive of postage and packing, unless otherwise stated.
2.3 All free covers are offered whilst stocks last and do not form part of the price offer. No discount will be offered to the stated price where a free item cannot be supplied.
3.1 Payment must be made in Pounds Sterling, unless otherwise specified, and by one of the following payment methods:

4. Passing of property
4.1 Oakita Limited shall retain the property of the goods at all times until full payment has been made by the customer and has been received by Oakita Limited. Delivery will only occur after full payment has been made, unless expressly agreed in advance.
5. Passing of risk
5.1 The risk in the goods shall pass to the Customer once the goods have been delivered or in the case of collection arranged by the Customer, once the item has been collected.
6.1 It is our policy to try to fulfil all orders on stocked items within the advertised and/or agreed delivery time frame. For Made To Order goods delivery will be as per date agreed (to be considered as indicative only). Orders for products that are not readily available for immediate sale, will not be accepted unless agreed to by the customer. In such a case, Oakita Limited will agree a delivery schedule, which shall also be considered as indicative only. Said products will be sent to the Customer as soon as possible once received from the Manufacturer. Oakita Limited accepts no liability or responsibility for delays in the delivery caused by the Manufacturer, or any other third party. Delivery is to the entrance floor of the property only.
6.2 Oakita Limited reserves the right to make partial deliveries should it be deemed appropriate. In such a case, consent and agreement will be sought from the Customer prior to despatch.
6.3 It is the Customer's responsibility to ensure their purchase will fit into the property. All measurements stated on furniture descriptions are approximate and it is the Customer's responsibility to clarify measurements prior to purchase should a small margin of error be critical to this decision. Should a delivery fail because the purchase cannot enter the property Oakita Limited will retain its reasonable costs incurred. A minimum of £50.00 (if the delivery address is within 200 miles of Oakita's business address) up to a maximum of £150 (if the delivery address is over 200 miles from Oakita's business address) will be retained from any refund given.
7.1 Oakita Limited only ships to Mainland UK destinations. In the vast majority of cases Oakita Limited will deliver your goods via its own delivery drivers and provide up to date information as to the delivery status and the location of your purchased goods. Oakita Limited will arrange a delivery date and time prior to the goods being despatched.
7.2 In the event of our drivers being unable to complete delivery because there is no suitable person available to accept delivery, the goods will be returned to Oakita Limited and the customer will be liable for the cost of re-delivery. Persons accepting delivery are considered suitable only if at the delivery address and over the age of 18. This charge must be settled before the goods are re-despatched.
7.3 Where an order is either designated as 'Free Shipping' or selected by the customer as 'Free Delivery', Oakita Limited will choose an appropriate and available shipping method whereupon the relevant shipping policy will apply as defined in these terms and conditions.
The Customer shall inspect the goods within a reasonable time period following receipt. The goods shall be deemed to have been accepted by the Customer 7 days after their receipt unless the Customer has notified the Seller that the goods are rejected. (This does not affect the Customer’s statutory rights). If no notification of rejection has been received after the aforementioned 7 day period, Oakita Limited shall consider the goods to be of satisfactory quality and fit for their purpose and may decline rejection thereafter. Non-faulty returns allowed under the Distance Selling Regulations will not apply to products purchased directly at our showroom or at shows and exhibitions regardless of whether they are taken away at time of purchase by the Customer or delivered by Oakita. Your statutory rights remain unaffected.
9. Return procedure
9.1 If the goods are to be rejected in the time limit set in clause 8 above, the Customer shall comply with the return procedure as defined in clause 9.2, below. Oakita Limited will reject returned goods that are unsolicited from Customers that have not complied with the procedure set in clause 9.2 below.
9.2 Goods that are rejected by the Customer must be returned in a saleable condition unless faulty. The return address is Oakita Ltd, Unit A, Chiltern Industrial Estate, Grovebury Road, Leighton Buzzard. LU74TU, United Kingdom. The goods should arrive with Oakita no later than 7 working days following the issuing of an acceptance of return. Only once Oakita Limited has received the returned goods and validated the nature of the return will a replacement or credit be issued. The cost of all returns and exchange are with the customer unless otherwise agreed. Oakita Limited accepts no responsibility for the care of the returned goods until they are received at their premises. Oakita Limited advise that returned goods are sent only via a trackable, insured shipping service. Should Oakita collect the goods, then a collection and restocking fee of £100 will be retained from any credit given. This does not affect the Customer's statutory rights.
In the event that a product becomes faulty during the guarantee period, Oakita Limited shall repair or replace the product which ever is the least cost option.
10.1 Cancellations are only accepted if the Customer complies with the following cancellation procedure and before the order has been dispatched. In store and in person orders will receive a credit note to the value of purchase upon cancellation. Orders online must be cancelled within seven days of purchase to qualify for a monetary refund.
A full credit will not be given on bespoke, made to order items where 50% of the purchase price will be credited by credit note.
10.2 Cancellations can be made with Oakita Limited by phoning our main UK number +44 (0)1525 373999 and requesting for the order to be cancelled. Customers will be provided with a Cancellation Reference Number (CRN). Where a credit note to the value of purchase is issued, this may be used as full or partial payment on any Oakita Limited products within 6 months of issue.
11. Copyrights and other Intellectual Property
Except where otherwise expressly noted, all contents of Oakita Limited owned literature or websites are the sole and exclusive property of Oakita Limited. The re-sale and/or re-labelling of any product sold by Oakita is expressly forbidden unless agreed beforehand in writing with Oakita Limited. The use of any Oakita Limited photographs without prior permission is strictly forbidden. Oakita Limited may at any time, make modifications, changes and alterations to the contents of its literature and websites including these Terms and Conditions, without prior notice. All product photographs are taken by and owned by Oakita Limited and are used together with the written description to inform the Customer of the appearance, dimensions and construction/quality of the product in order for the Customer to make an informed decision regarding purchase. All photographs together with the written description should be considered by the Customer before purchase as Oakita Limited reserves the right to add changes to an original image where the original product is deemed close to the product offered for sale. For example, where a seasonal colour change is offered, photographs of the colour change along with a clear description of the colour may be added to a prior product photograph of a different shade. Oakita reserves the right to not re-photograph products where small changes are made to the design.
